General Terms and Conditions

1.1 General

These general terms and conditions apply to every offer made by the entrepreneur and to every distance contract concluded between Happy by Lies and the customer (consumer or business customer). Unless Happy by Lies has expressly agreed in writing to other terms and conditions. Any exceptions agreed upon cannot be used to derive any rights for future transactions.

Before the distance contract is concluded, the text of these general terms and conditions will be made available to the consumer. If this is not reasonably possible, it will be indicated before the distance contract is concluded that the general terms and conditions can be viewed at the entrepreneur's premises and will be sent free of charge to the consumer as soon as possible upon request.

Accepting an offer and/or placing an order implies that the buyer accepts the applicability of these terms and conditions.

The most common situations are described in these general terms and conditions. If a situation arises between Happy by Lies and the buyer that is not regulated in these general terms and conditions, this situation must be assessed in accordance with the spirit of these general terms and conditions. 1.2 Prices and offers
All prices on our website include 21% VAT and exclude shipping costs.

Unless the agreement has been concluded, Happy by Lies is authorized to change prices, offers, and other conditions. Buyers cannot derive any rights from prices and offers from the (recent) past.

Happy by Lies cannot be held to prices or offers if the buyer could reasonably have understood that the price or offer, or any part thereof, contains an obvious error or clerical mistake.

1.3 Shipping costs
The shipping costs charged for shipments within the Netherlands for every order amount to: Free shipping
If the buyer orders multiple items, the shipping costs remain the same.

1.4 Deliveries
Happy by Lies strives to ship all orders within 1-3 working days, but no later than 3 weeks after receipt of payment; however, in principle, an order will always be sent to the address you provided within 3 weeks after receipt of payment.

The consumer must understand that all items are handmade and that custom-made items have a longer delivery time. This will always be discussed with Happy by Lies.

If items have a longer delivery time or cannot be delivered (temporarily), you will be notified of this via email within 3 days.

Happy by Lies is not liable for delays caused by postal and parcel delivery services.

Happy by Lies is not liable for any damages whatsoever resulting from exceeding the announced delivery times.

Happy by Lies exercises the utmost care when receiving orders and shipping ordered items. Nevertheless, it may occur that an order is not delivered or is delivered incompletely. You must report this within 7 days of receiving the items. The delivery will then be supplemented or redone at Happy by Lies' expense if necessary.

1.5 Payment Options
The purchase and sale agreement is concluded at the moment you accept the offer and meet the conditions set out therein. As long as receipt of this acceptance has not been confirmed by email, the customer may dissolve the agreement.

The amount due can be paid via IDEAL. Happy by Lies accepts IDEAL payments from Dutch banks.

Upon receipt of the amount, the items will be delivered to you.

Returns

You have the right to cancel your order up to 14 days after receipt without giving any reason. After cancellation, you have another 14 days to return your product. You will then be credited the full order amount, including shipping costs. Only the costs for returning the item from your home to the webshop are at your own expense. If you exercise your right of withdrawal, the product must be returned to the entrepreneur with all delivered accessories and – if reasonably possible – in its original condition and packaging. To exercise this right, please contact us via happybylies@zeelandnet.nl. We will then refund the order amount due within 14 days after notification of your return, provided the product has already been received back in good order.

 

Return exceptions

List the exceptions to the right of withdrawal here. Also indicate clearly on the product itself that it cannot be returned once ordered by the consumer. Please note:

Exclusion of the right of withdrawal is only possible for products:

In the case of sealed products. If the seal is broken, these products are non-returnable.

that have been produced by the entrepreneur in accordance with the consumer's specifications;

that are clearly personal in nature;

that cannot be returned due to their nature;

that can quickly spoil or become obsolete;

whose price is subject to fluctuations in the financial market over which the entrepreneur has no influence;

for individual newspapers and magazines;

for audio and video recordings and computer software where the consumer has broken the seal. Warranty

1.7 Liability
Any liability of Happy by Lies, its staff, and its products for all damages, of whatever nature, direct or indirect, is excluded. Happy by Lies is also not liable for damage caused by third parties during the execution of the agreement.

Happy by Lies accepts no liability for any damage arising from the use of Happy by Lies products.

The liability of Happy by Lies is always limited to a maximum of the purchase price of the relevant item.

Happy by Lies is not liable for misunderstandings, mutilations, delays, or improper transmission of orders and communications resulting from the use of the Internet or any other means of communication in the traffic between you and Happy by Lies, or between Happy by Lies and third parties, insofar as this relates to the relationship between you and Happy by Lies, unless there is intent or gross negligence on the part of Happy by Lies. 1.8 Force Majeure
Happy by Lies is not obliged to fulfill any obligation towards a buyer if it is hindered in doing so as a result of a circumstance that is not attributable to fault, and which is not for its account pursuant to the law, a legal act, or generally accepted views. In these general terms and conditions, force majeure is understood to mean, in addition to what is understood in this regard in the law and jurisprudence, all external causes, foreseen or unforeseen, over which Happy by Lies cannot exercise influence, but which render Happy by Lies unable to fulfill its obligations. Happy by Lies also has the right to invoke force majeure if the circumstance preventing (further) fulfillment of the agreement occurs after the User should have fulfilled its obligation.

If the period during which the force majeure occurs is longer than two months, both you and Happy by Lies have the right to dissolve the agreement without any obligation to pay compensation.

 

1.9 Privacy

Happy by Lies respects the privacy of all users of its site and ensures that the personal information you provide to us is treated confidentially. Your personal data is used for processing the order.

In addition to fulfilling orders, the data will be used, exclusively with your consent, for marketing purposes and maintaining the customer relationship with you.

The data will never be made available to third parties, unless that party is involved in manufacturing or fulfilling your order.

1.10 Applicable Law
The agreement and these general terms and conditions are governed exclusively by Dutch law.

1.11 Complaints

It is always possible that something does not go entirely as planned. We advise you to first submit complaints to us by emailing www.happybylies@zeelandnet.nl. If this does not lead to a solution, it is possible to register your dispute for mediation via Stichting WebwinkelKeur at https://www.webwinkelkeur.nl/kennisbank/consumenten/geschil. As of 15 February 2016, consumers in the EU can also submit complaints via the European Commission's ODR platform. This ODR platform can be found at http://ec.europa.eu/odr. If your complaint is not already being handled elsewhere, you are free to file your complaint via the European Union platform.
